Regarding the Short-Term Employment of Third-Country Nationals in Hungary
Third-country
nationals’ short-term stay in Hungary
is defined as a planned stay in Hungary not exceeding 90 days within any 180‑day
period.
A
third-country national holding a visa entitling them to short-term stay in
Hungary, as well as a person lawfully residing in Hungary as a visa‑exempt
national of a third country listed in Annex II of Regulation (EU)
2018/1806 of the European Parliament and of the Council, may perform work—unless otherwise
provided by Act XC of
2023 on General Rules for the Admission and Right of
Residence of Third‑country Nationals. However, this does not exempt them from
fulfilling the conditions prescribed in other legislation in relation to
employment, in particular the requirement to obtain a work permit issued by the competent employment authority.
If you intend
to employ third‑country nationals for a period not exceeding 90 days, please be
advised to review Government
Decree no. 445/2013 (of 28 November) on the authorisation of the
employment of third‑country nationals in Hungary under a non‑single‑application
procedure, on exemptions from the authorisation requirement, on the involvement
of the employment centres of the government office of the Capital and county
government offices as specialised authorities in the single application
procedure, on the notification of the employment of third‑country nationals who
may work in Hungary without a permit, and on the reimbursement of wages, as
well as, to contact the competent government office as per the prospective
place of employment for the purpose of applying for a work permit (https://kormanyhivatalok.hu/kormanyhivatalok).
If the
government office issues a positive decision on the third‑country national’s
application for a work permit, the visa‑required foreign national shall submit their application for a short‑stay visa
at the competent Hungarian diplomatic or consular post as per their nationality
or permanent residence. If the third‑country national is entitled to visa‑free
entry into the territory of the Member States of the European Union, (s)he may
enter Hungary without applying for a visa after obtaining the work permit and
may commence employment not exceeding 90 days.
Please be
informed that neither the employer nor the employee has any reporting
obligation to the National Directorate‑General for Aliens Policing
(hereinafter: Directorate‑General) in relation to the employment relationship.
In case of a
stay in Hungary exceeding 30 days but not reaching 90 days, the client is
required to report their accommodation to the immigration authority after
his/her entry via the Enter Hungary application platform (https://enterhungary.gov.hu/eh/?hu).
Based on the report, the Directorate‑General will issue a certificate on place of accommodation
electronically, in addition to the work permit.
Finally, please be informed that the Directorate‑General, in cooperation with other authorities, may examine the intention of third‑country nationals to enter the territory of the Schengen Member States, as well as their actual purpose of stay following entry into Hungary, the fulfilment of the conditions of stay, and their departure prior to the expiry of their visa.
